TERMS AND CONDITIONS OF ARKAIOS MOBILE APP GAME

These Terms and Conditions (the "Terms" or "Agreement") govern the access to and use of the Arkaios mobile application, including all related services, content, features, and subscription offerings (collectively, the "Service"), operated by Arkaios Studio Kft. (the "Service Provider", "we", "us", or "our"). By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. SERVICE PROVIDER INFORMATION

2. DESCRIPTION OF THE SERVICE

The Service is a digital game application that may be accessed through supported mobile platforms. Certain features of the Service are available free of charge, while additional optional features are provided through an optional, recurring subscription known as "True Spirit". The True Spirit subscription is designed to enhance the gameplay experience but is not required to access or complete the core game.

3. ACCEPTANCE, AVAILABILITY, AND MODIFICATION OF TERMS

3.1. Acceptance of these Terms occurs upon registration within the Application. Continued use of the Service constitutes ongoing acceptance of the Terms as in force at the time of use.

3.2. The current version of these Terms is published on the Service Provider's website and is accessible to Users exclusively via a link provided within the Application.

3.3. The Service Provider reserves the right to amend or modify these Terms at any time unilaterally. Any such modification shall become effective upon publication. If you do not agree to the modified Terms, you must immediately cease using the Service.

4. ELIGIBILITY AND REGISTRATION

4.1. The Service may not be used by children under a certain age (specified in the store from which the app is downloaded).

4.2. Registration is mandatory to access and use the Service.

4.3. You represent and warrant that all information provided during registration is accurate, complete, and truthful.

5. USER ACCOUNT AND SECURITY

5.1. You acknowledge that you are solely responsible for the confidentiality and security of your account credentials.

5.2. You may not sell, transfer, share, or otherwise allow third parties to use your account.

5.3. The Service Provider shall not be liable for any loss, damage, or unauthorized activity resulting from the misuse of your account or credentials.

5.4. You must immediately notify the Service Provider if you suspect any unauthorized access to or use of your account.

6. TRUE SPIRIT SUBSCRIPTION

6.1. Subscription Plans True Spirit is offered as a time-based subscription with available durations of one (1) month and twelve (12) months. Longer subscription periods may be provided at a discounted effective monthly price.

6.2. Pricing and Availability Subscription pricing, duration, and availability may vary by platform, region, or over time and are displayed at the time of purchase via the applicable app store.

7. SUBSCRIPTION BENEFITS

7.1. Active True Spirit subscriptions may provide access to additional in-game benefits, including but not limited to: (a) quality-of-life features such as faster or skippable animations; (b) additional gameplay insights or information; (c) reduced or removed in-game advertisements; (d) other premium features introduced in the future.

7.2. The specific benefits included in True Spirit are described within the Application and/or on the relevant app store page and may change over time.

8. CHANGES TO SUBSCRIPTION BENEFITS

The Service Provider reserves the right to update, modify, add to, or adjust the benefits associated with True Spirit as part of ongoing development, balancing, feature improvements, or technical updates, provided that such changes do not materially reduce the overall value of the subscription during an active subscription period.

9. AUTO-RENEWAL, BILLING, AND CANCELLATION

9.1. True Spirit subscriptions automatically renew at the end of each subscription period unless cancelled prior to renewal.

9.2. Payment will be charged to the User's platform account at the time of purchase and upon each renewal, in accordance with the terms of the applicable app store.

9.3. Users may manage or cancel their subscription through the account settings of the platform from which the subscription was purchased.

9.4. Cancellation takes effect at the end of the current billing period. No refunds or partial refunds are provided for unused subscription time, except where required by mandatory law.

10. ADVERTISEMENTS

Users without an active subscription may be shown in-game advertisements. Active True Spirit subscribers may receive reduced advertisements or no advertisements, depending on the current implementation of the Service.

11. NO OWNERSHIP, ACCOUNT BINDING, AND TRANSFERABILITY

11.1. True Spirit subscriptions grant access to certain in-game features solely for the duration of an active subscription and do not confer ownership of any in-game content.

11.2. Subscriptions are purchased through third-party platform accounts and may be bound to a single in-game account.

11.3. At any given time, one platform subscription may be associated with only one in-game account. Simultaneous use across multiple in-game accounts is prohibited.

11.4. Subscriptions are personal, non-transferable, and may not be shared, sold, or used concurrently by multiple users.

12. INTELLECTUAL PROPERTY AND LICENSE

12.1. All content, software, features, and materials within the Service are the exclusive intellectual property of the Service Provider.

12.2. The Service Provider grants to the User a non-exclusive, non-transferable, revocable, limited, personal, non-commercial license to use the Service.

12.3. Any copying, modification, reverse engineering, redistribution, or commercial use of the Service or its content is strictly prohibited.

13. USER CONDUCT, MODERATION, AND TERMINATION

13.1. The Service may include synchronous and asynchronous gameplay modes.

13.2. The Service Provider reserves the right to moderate user activity and to suspend or terminate user accounts at any time without notice in the event of a violation of these Terms.

13.3. In the event of suspension or termination due to a breach of these Terms, the User shall not be entitled to any refund of subscription fees.

14. DISCLAIMER AND LIMITATION OF LIABILITY

14.1. The Service is provided on an "as is" and "as available" basis.

14.2. The Service Provider does not guarantee that the Application will be completely error-free or without any interference.

14.3. Use of the Service is at the sole risk of the User.

14.4. To the maximum extent permitted by law, the Service Provider's liability under any provision of this Agreement shall in any case be limited to the amount paid by the User for the Service or subscription.

15. WITHDRAWAL AND REFUNDS

The User acknowledges and accepts that, due to the digital nature of the Service and immediate performance, the User has no right of withdrawal from the present contract after the Purchase, except where mandatory consumer protection laws apply.

These terms and any rights and obligations arising out of or in connection with them shall be governed by and construed in accordance with Hungarian law only and in all cases. Any dispute, controversy, or claim arising out of or in connection with these terms or the breach, termination, or invalidity thereof shall be finally settled by any court procedure of competent jurisdiction and venue at the seat of the Service Provider, as determined by the competent court of law under Hungarian civil procedure law. The language of the court proceedings shall be Hungarian.

If any provision of these terms is held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision shall be modified, limited, or terminated to the minimum extent necessary to ensure that these terms otherwise remain in full force and effect.

The Service Provider shall notify the User of all information related to these terms through the Service or through the e-mail address provided by the User.

The User may send any notifications, questions, or complaints regarding the Service or these terms to the Service Provider using the following contact details:

The Service Provider will handle any complaints in the following manner. The User may submit a complaint in writing to the Service Provider by sending an email to hello@arkaiosstudio.com. The Service Provider shall create a unique identifier for complaints sent electronically. The Service Provider is obliged to reply to the written complaint within 60 (sixty) days of receipt and to give reasons for the rejection. The Service Provider shall keep a record of the complaint for five years. In the event of rejection of the complaint, the Service Provider shall inform the User of the authority or conciliation body to which the User may address the complaint. The User acknowledges and accepts that, in accordance with Article 29 (1) m) of the Hungarian Governmental Decree no. 45/2014 (II.26.), the User has no right of withdrawal from the present contract after the Purchase of the TRUE SPIRIT SUBSCRIPTION PLAN.
